Fire, Engineering and General Accident Insurance

1- Fire Insurance

Fire insurance policy

This policy covers property (buildings and contents) against fire and lightning, and extends to include:

  • Explosion, vehicle impact and falling aircraft.
  • Riots, workers' strikes and malicious acts.
  • Whirlwinds, storms, floods and water damage.
  • Legal liability towards neighbours and owners, and loss of rent.

2- Engineering Insurance

1Contractors' All Risks Policy (CAR)

This insurance covers the project works carried out by the contractor against all risks, for the main contractor or subcontractors, that may occur suddenly and unexpectedly during the project execution period or the subsequent maintenance periods.

Main coverage:

  • Permanent and temporary contract works, including all materials used in executing the project works.
  • Construction equipment and tools and surrounding property used in executing the project, within their replacement values.
  • Legal liability towards third parties covering bodily injury and material damage to the property of others.
  • Cost of debris removal related to a covered incident on the project.
2Erection All Risks Policy (EAR)

This insurance is designed to cover all project installation works carried out by the contractor against project-related risks, including normal tests and operational tests in addition to maintenance works.

Main coverage:

  • Installation works, including all materials to be installed, in addition to installation costs, shipping expenses and customs duties.
  • Construction equipment and tools used in executing the project, within their replacement values.
  • Existing property and property surrounding the site.
  • Cost of debris removal related to a covered incident on the project.
  • Legal liability towards third parties covering bodily injury and material damage to the property of others.
3Equipment All Risks Policy – Plant and Machinery

This insurance is designed to compensate the insured for material damage to equipment and machinery resulting from an accidental and sudden incident while the equipment is:

  • Operating or at rest.
  • Dismantled for periodic maintenance.
  • In automatic operation.
  • During reassembly for operation.
4Machinery Breakdown Policy

This policy compensates the insured for material damage resulting from breakdown of the insured machinery as a direct result of casting defects, design errors, lack of operating skill, water shortage in boilers, physical explosion of boilers or electrical short circuit.

The sum insured must equal the replacement value of the insured equipment.

5Loss of Profits from Machinery Breakdown Policy

This policy compensates the insured for loss of profits (financial losses) suffered by the insured company / institution after one or all of the insured equipment suffers a mechanical or electrical breakdown that disrupts or stops production.

6Electronic Equipment Policy

This policy provides comprehensive cover against sudden accidents and material damage to electronic devices such as computers, electronic server networks, electronic telephone networks and medical equipment, with compensation based on the replacement values of such equipment, during:

  • Periods of operation or stoppage.
  • Dismantling for cleaning and periodic maintenance.
  • Reinstallation / reassembly.

Coverage also extends to include:

  1. Costs of recreating materials saved on various external storage media.
  2. Costs related to restarting operations after an incident covered by the policy.
7Deterioration of Stock in Refrigeration Units Policy

This policy compensates the insured for loss of or damage to perishable goods (for example foods such as fish, meat, vegetables, fruit, dairy products and the like) after one or all of the insured equipment suffers a breakdown that spoils the stock as a result of an accidental and sudden incident, provided that the refrigeration units storing these goods are insured under a machinery breakdown policy.

3- Liability Insurance

1Legal Liability towards Third Parties Policy

This insurance provides protection against legal liabilities towards third parties arising directly from and related to the insured's activity, within the scope of carrying out such works or activities, which may lead to bodily injury or material damage to others.

A third party can be defined as:

  • Any person other than a member of the insured's family or any of their dependants or employees.
  • Any property belonging to others, other than property of the insured or their family, or in their custody and under their personal or corporate care.
2Professional Indemnity Policy

This insurance provides protection against legal liabilities towards third parties arising directly from and related to the insured's professional activity (such as architectural and civil consulting, accounting and auditing, legal practice and the like) as a result of the insured's failure to meet their professional responsibility due to an omission or error in performing those tasks themselves or through one of their employees or dependants.

3Product Liability Policy

This insurance provides protection against legal liabilities towards third parties as a direct result of the following:

  • Use of a particular product produced or distributed by the insured that caused bodily injury (including death or illness) or material damage to any user of the product.
  • Failure of the product sold to perform the function for which it was manufactured, designed or sold.

4- General Accidents

1Money Insurance Policy

This insurance provides cover for loss of money in case of theft or robbery while:

  • In transit.
  • On the insured's premises for use during working hours.
  • In the insured's safes, strong rooms or cash machines.
  • Money is defined as cash notes, cheques or bank papers of a financial nature, financial credits, payment orders and the like.
2Fidelity Guarantee Insurance

This policy compensates the insured for financial losses incurred due to forgery, embezzlement or theft by the insured's employees entrusted with cash or financial transactions (who must be named in the policy schedule).

3Glass Breakage Policy

This policy compensates the insured for glass breakage from any risk except those expressly stated in the policy as exclusions. Compensation is by repairing or replacing the broken panes up to the sum insured shown in the policy schedule.

4Theft Insurance Policy

This policy compensates the insured for losses and damage to the insured's property resulting from theft and break-ins. Cover is conditional on force being used to enter or exit the place of the incident.

5Personal Accident Policy

This policy provides insurance protection 24 hours a day worldwide and is specially designed to compensate the insured for accidents that may (God forbid) lead to death or total or partial, temporary or permanent disability.

Compensation is paid to the insured or their legal representatives according to the sums insured and the compensation percentage limits stated in the policy schedule, provided the insured is older than 15 and younger than 65.

6Workmen's Compensation Policy (under Kuwaiti Labour Law)

This policy covers the insured's workers and employees against bodily injury, disability or death (God forbid) resulting from performing their daily work duties within the workplace, in accordance with the Kuwaiti labour law in force at the time of the accident. Cover extends to accidents while travelling to and from the workplace or residence, and may also extend to include the following:

  • Employer's tort liability within agreed limits.
  • Cover for injuries caused by war remnants.
  • Occupational diseases.
  • Sunstroke.
  • Hernia.
  • Work on Fridays, public holidays and during overtime, provided the insurance company is informed of the additional wages paid.
  • Medical expenses related to the accident.
7Employer's Legal Liability Policy

This policy covers the insured for amounts legally payable under an enforceable court judgment for their liability as an employer towards their employees, as a result of injury, disability or death of a worker or employee due to the employer's negligence. This cover is only provided when cover exists under a workmen's compensation policy.

8Bankers' Blanket Policy (Banks)

This policy provides comprehensive cover specially designed for the banking sector against accidents and damage that may result from the various activities of financial institutions in this sector, in the form of a combined policy covering the following:

  • Breach of trust by employees.
  • Loss of property within the building.
  • Loss of money and valuable movables.
  • Forgery, embezzlement and manipulation of bank papers, payments and the like.
  • Loss of securities such as shares, bonds, sukuk, treasury bills, letters of guarantee, documentary credits and the like.
  • Loss of or damage to offices and their contents.
  • Losses resulting from liability for professional errors.
  • Losses resulting from electronic theft crimes.
9Directors' and Officers' Liability Policy

This insurance covers the legal liability of the company's directors and officers for negligent conduct, whether by error or omission, towards others (including amounts the company may pay on behalf of its employees), for unintentional mistakes resulting from omission or error within the scope of the director's or officer's authority as a decision maker.

The policy is provided in two sections:

  • Section one concerns compensation for the liabilities of directors and officers for unintentional administrative errors resulting in material or bodily damage to others, for amounts which the company is not liable or not legally authorised to indemnify the director or officer for.
  • Section two concerns compensation for the liabilities of directors and officers for unintentional administrative errors resulting in material or bodily damage to others, for amounts which the company is liable or authorised to indemnify the director or officer for.
10Decennial Liability Policy (Latent / Hidden Defects)

This insurance covers material / financial losses to property resulting from design defects or defects in construction materials that occur during the construction period of the project but are not discovered or identified until after the project is finished, completed and handed over to the owner. This insurance is usually issued for ten years from the date of completion of the project, and the cover may be granted to owners or required from contractors while carrying out the project.
